Fatemeh Derakhshandeh Tosarvandan, an Iranian woman accused of adultery, is currently seeking asylum in Canada with her 16 year old son from the harsh punishment that awaits her back home if she is found guilty. In Iran, women convicted of adultery face a possibility, albeit diminshed in recent years, of being stoned to death.
Though she is safe for the time-being, Canada might yet deport her back to Iran — essentially over a bureaucratic timing issue.
According to The Star, Ms. Tosarvandaner could not prove initially that her husband had officially filed charges of adultery. This led to a rejection of her asylum claim. Because of a recent “tightening” of immigration laws, Tosarvandaner will be unable to reapply for asylum until next year, and subsequently faces deportation by immigration officials.
Tosarvandan doesn’t believe she will get a fair trial in Iran. Canada probably doesn’t think she’ll get a fair trial either — they recently suspended diplomatic relations with the Tehran. The foreign affairs minister John Baird told The Star that Iran “poses most significant threat to global peace.”
Tosarvandan lawyer’s requests to have the deportation, slated for October, postponed due to the extreme circumstances were rejected. She may have to leave Canada as soon as the end of this week.
